Dreamcricket Free Fantasy Challenge Rules - Legal Restrictions


1. REGISTRATION

PARTICIPATION BY REGISTRATION IS NECESSARY. THE DREAMCRICKET FREE FANTASY CHALLENGE IS A GAME OF SKILL!

From all eligible entries received, the winners will be determined based on their ability to use their skill and knowledge of cricket and dreamcricket's fantasy cricket Rules to gain the most value for their team during the term of tournament according to the Rules.

One person may register up to 3 teams in a tournament to be eligible for prizes. There is no entry fee for FREE FANTASY CHALLENGE.

DreamCricket is an online game of skill. We can only accept entries upon proper online registration.

2. ELIGIBILITY

    2.a. Age: IMPORTANT: There are no age restrictions for this free online game.

    2.b. Who may play: This game is open to any follower of cricket who abides by the rules of the game.

    If you are a US resident, all federal, state and local laws and regulations apply in all cases.

    Although there are no age restrictions for participation, prize amounts may not be awarded to participants less than 21 years of age without prior consent of their guardians. In addition, winners in some countries may be required to take and pass a timed math skill-testing question before you claim your prize.

    You must at all times note that this is a free fantasy tournament with no expectation of prizes unless you are a winner as determined by the Commissioner.

    2.c. Persons residing in any other jurisdictions or countries other than USA and Canada:

    If your local laws prohibits acceptance of prizes by winners in free online games, you will not be eligible to win any prizes as stated in Section 11 below. Please note that your standing will be noted on our website even though you will not be eligible for any prizes or prize amounts.

    If you live outside USA and Canada and your local law allows winners to accept prizes in fantasy tournaments, then we will issue a check once the required procedures are completed to establish your age and validity of entry.

    In order to facilitate this validation, we will need for you to claim your prize in writing and sign an affidavit stating that you are 21 years or older and your acceptance of the prize amount is completely in accordance with your local laws (in addition to your obligations listed below). It is your responsibility to comply with the laws that apply to your jurisdiction and to declare any prize winnings for tax purposes.

    2.d. Who may not play: Employees and the immediate families of employees of Indus Business Solutions, their affiliates, licensees, sponsors, advertising and promotion agencies and contest promotional partners are not eligible to participate in this Contest. If we suspect foul play or feel that the contestant is not abiding by the rules and terms specified here, we reserve the right to turn off a participant or refuse a contestant the right to play before or after they have registered.

3. HOW TO ENTER

You may access the Game, by logging on to http://www.dreamcricket.com/dreamcricket/membership/login.asp

To enter the Game, you must be a registered member of dreamcricket.com.

Registration is free. If you are not a member, you can become one by following the instructions.

You will be asked to provide your name, e-mail address, zip code, birth date, gender and to select a password. You will also be asked to consent to receive promotional e-mails. You may opt out of promotion e-mails. It is not needed in order to become a member. As a member, you may enter the Game by first logging in to the system with your current username and password. You may then be asked to answer survey questions or to consent to receive promotional e-mails.

Answering survey questions too does not have to be agreed to in order to be eligible to enter the Game.

4. E-MAIL CHANGE OF ADDRESS POLICY

It is the sole responsibility of the entrant to notify dreamcricket.com if his or her e-mail address changes.

To do so, email us a change of email address request at info@dreamcricket.com.

5. ELECTRONIC COMMUNICATIONS

Indus Business Solutions is not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries.

Entry materials/data that have been tampered with or altered are void. Once submitted, entries become the sole property of Indus Business Solutions and will not be returned. In case of dispute as to identity of a winner, the registered user of the e-mail account will be regarded the entrant upon producing valid proof. If a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user.

6. PURCHASING A TEAM

The deadline to purchase a team will be published for each individual tournament on www.dreamcricket.com. That will also be the deadline if you would like to pay and participate in the DreamCricket FREE FANTASY Challenge.

Entries will only be accepted through the online entry and selection form available.

No faxed, mailed, electronically mailed, or phoned in entries are allowed.

7. Multiple entries from a single person

We may disallow a registered user from registering more than 3 entries. One person may only win one prize regardless of the number of entries. If a registered user registers more than 3 entries, he will automatically be ineligible for a prize. We strongly recommend that you register no more than 3 teams.

8. Account termination

Indus Business Solutions will terminate Customer's account upon notice from Customer. After entering, entrants may access their team to track performance by logging into the Game and clicking on their team.

9. GAMBLING PROHIBITION

The Game may not be used in connection with any form of gambling. We run this game purely for the purpose of testing cricket skill and knowledge.

10. HOW TO PLAY

The Game provides participants the experience of selecting a cricket side and managing it throughout a tournament. With the help of trades, player stats, etc. participants compete against fellow cricket fans in a simulated fantasy tournament. The players on a team's active team generate statistics provided from actual cricket games being played, which in turn earn points that are added together for a daily score. In some cases, the Game will combine several actual cricket tournaments into a single Pro Challenge tournament. Customers will be notified about the tournament on www.dreamcricket.com. 11. PRIZES TO GROUP

For the purpose of this game, a group, a league or an office pool includes several people playing against each other in a closed group. For the purpose of the ongoing Ashes 2006 game, a group will comprise of at least a 10 entries. We will award an Ashes 2005 3-DVD NTSC Region 1 set or Dreamcricket Gift Certificate valued at $25 to the first five groups that have 10 or more unique captains. The leader of the group will be given this prize. In addition,the group, which has 10 or more unique captains, and also gets the highest average rank among all the participants, gets a prize (cash or Dreamcricket Gift Certificate) worth $500. Once again, since this is an incentive to the leader, only the leader of the group will receive this prize and not the group members. It is that leader's prerogative to distribute the prize. Finally, the leader of the group with the highest number of unique participants (as determined by the Commissioner based upon registration data, relying on unique e-mail ids, ip addresses or unique mailing addresses) will receive $250 cash or Dreamcricket certificates worth $250.

12. ADDITIONAL PRIZES

IMPORTANT: Limit 3 entries per person. One prize per person!

The prizes for Ashes 2006 are -

FIRST PRIZE: US$3000 or Dreamcricket gift certificates with a purchase value of US$1000.

SECOND PRIZE: US$1000 or Dreamcricket gift certificates with a purchase value of US$400.

The prizes are not transferable except to a legal guardian if necessitated by local laws. We will not give a prize to another person if the rightful winner does not come forward and claim his or her prize.

Indus Business Solutions will confirm on www.dreamcricket.com the prizes and their amounts after the freeze. Any changes to the prizes will be posted to the website as well.

All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES AND ANY SHIPPING OR HANDLING CHARGES ARE THE SOLE RESPONSIBILITY OF THE WINNER.

14. NOTIFICATION

Overall winners will be notified by e-mail or regular mail within seven (7) days after the date the winners are determined. Winners must sign and return an affidavit of eligibility and a publicity/liability release (unless prohibited by law) within fifteen (15) days following attempted notification.

Failure to comply with this requirement may result in disqualification and selection of an alternate winner.

Any prize notification returned as undeliverable may result in disqualification of the winner.

Using the contact information the user has provided, Indus Business Solutions will attempt to contact overall winners via phone and/or e-mail in order to fulfill prizes at least three (3) times or for a period of ninety (90) days. If the winner is unable to be reached, this may result in disqualification.

Indus Business Solutions reserves the right to send their prize to the last known address on record and is not liable for lost or stolen mail.

15. CONDITIONS OF PARTICIPATION

Game entrants agree to abide and be bound by the terms of these Legal Restrictions and by the decisions of the judges, which are final on all matters pertaining to this Game.

Indus Business Solutions and participating promotional companies (and the affiliates and subsidiaries of each) and agencies (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty; and (iii) are not in any way responsible or liable for damage, loss or injury resulting from altered, late, lost, damaged, misdirected, mutilated, inaudible, illegible or incomplete entries, or human, telephone, computer, online, or technical malfunctions or failures (including busy lines and disconnections), or acceptance and use of a prize or travel in connection with such prize.

Winner assumes liability for injuries caused or claimed to be caused by participating in the Game, or by the acceptance, possession or use of any prize.

By participating, entrants release Indus Business Solutions, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses, or damages of any kind caused by participation in the Game or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities.

Where legal, by accepting prize, winner grants permission to use his/her name, address, likeness, photograph, and statements by Indus Business Solutions, its affiliates, subsidiaries, and advertising/promotional agencies for advertising/publicity purposes without further compensation or authorization.

Indus Business Solutions is not responsible for typographical or other errors in the offer or administration of this Game, including but not limited to errors in advertising, the Legal Restrictions, the selection and announcement of the winner or the distribution of the prizes.

16. CONDUCT.

The Legal Restrictions will be posted at the Game web site throughout the Game Period.

Indus Business Solutions reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Game or web site; to be acting in violation of the Legal Restrictions; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

Indus Business Solutions reserves the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Game.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, INDUS BUSINESS SOLUTIONS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

17. LIMITATIONS OF LIABILITY

Indus Business Solutions is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Game or by any technical or human error that may occur in the processing of submissions in the Game.

Indus Business Solutions assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft of or destruction or unauthorized access to, or alteration of, entries.

Indus Business Solutions is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or entrants due to or resulting from technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Game.

If, for any reason, the Game is not capable of running as planned due to:
(a) infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Indus Business Solutions, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Game; or
(b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared) Indus Business Solutions reserves the right at its sole discretion to cancel, terminate, or suspend the Game and in such event, to select winner by random drawing from all valid entries received up to the time of cancellation, termination or suspension.

18. RULES; WINNERS LIST

This Game is subject to these Legal Restrictions and Game Rules, and any other rules sets expressly referenced herein. Indus Business Solutions reserves the right to change these Legal Restrictions at any time, in its sole discretion.
